Contrairement à d’autres pays, ce n’est pas le notaire qui protège vos intérêts en Espagne ; c’est un fonctionnaire impartial qui authentifie l’acte, sans vérifier pour vous ce qui doit l’être. C’est votre avocat indépendant qui joue ce rôle. Un réflexe à corriger tôt, surtout si vous arrivez d’un pays où le notaire fait habituellement ce travail à votre place.

⚠️ The one thing that changes everything!
Unlike in some other countries, the notary does not protect your interests in Spain — they’re an impartial official who authenticates the deed, without checking on your behalf what needs checking. That’s your independent lawyer’s job. Worth correcting early, especially if you’re coming from a country where the notary usually does that work for you.

L’agent immobilier (agente inmobiliario/API)
| QUAND Recherche la mise en relation avec le vendeur. |
| SON RÔLE Présente les biens, organise les visites, aide à la négociation. |
| À CONSULTER POUR Trouver un bien, être mis en relation avec des professionnels locaux. |
Real Estate agent (agente inmobiliario/API)
| WHEN Search stage and introduction to the seller. |
| THEIR ROLE Shows properties, arranges viewings, helps with negotiation. |
| CONSULT THEM TO Find a property, get introduced to local professionals. |
L’avocat (abogado)
| QUAND Dès l’offre — avant de verser un acompte ou de signer le contrat d’arras (compromis). |
| SON RÔLE Vérifie la Nota Simple (registre de la propriété), les dettes et hypothèques, les licences, la conformité entre surface déclarée et surface réelle. Rédige les clauses protectrices et peut agir par procuration (poder notarial) pour signer en votre absence. |
| À CONSULTER POUR Avant tout acompte ou signature de contrat, pour toute vérification préalable, pour être représenté à distance. |
The Lawyer (abogado)
| WHEN From the offer stage — before paying a deposit or signing the arras contract (preliminary agreement). |
| THEIR ROLE Checks the Nota Simple (land registry extract), debts and mortgages, licences, and whether the declared surface area matches reality. Drafts protective clauses and can act under power of attorney (poder notarial) to sign in your absence. |
| CONSULT THEM TO Before any deposit or contract signing, for any preliminary check, or to be represented remotely. |
Le notaire (notario)
| QUAND À la signature de l’acte final (Escritura Pública). |
| SON RÔLE Fonctionnaire public impartial : authentifie l’acte, vérifie l’identité des parties et les pièces indispensables à sa validité. |
| CE QU’IL NE FAIT PAS Ne vérifie pas l’urbanisme, ne fait pas de vérification approfondie du bien, ne représente aucune des deux parties. |
The Notary (notario)
| WHEN At the signing of the final deed (Escritura Pública). |
| THEIR ROLE An impartial public official: authenticates the deed and checks the parties’ identity and the documents required for its validity. |
| WHAT THEY DON’T DO They don’t check planning compliance, don’t carry out an in-depth property check, and represent neither party. |
Gestor / Gestoria (agent administratif)
| QUAND Après la signature chez le notaire. |
| SON RÔLE S’occupe des démarches administratives post-signature : paiement des taxes de transfert, inscription au Registre de la Propriété. |
| À CONSULTER POUR Ne pas avoir à gérer seul la paperasse fiscale et administrative après l’achat. |
Gestor / Gestoria (administrative agent)
| WHEN After signing at the notary’s office. |
| THEIR ROLE Handles the post-signing paperwork: paying the transfer taxes and registering the property at the Land Registry. |
| CONSULT THEM TO Avoid handling the tax and administrative paperwork alone after the purchase. |
Renseignez-vous, ne devinez pas
Ne soyez ni négligent, ni naïf, ni je-m’en-foutiste sur ce sujet précis. Les textes changent, les pratiques locales aussi, et ce qui était vrai il y a deux ans ne l’est parfois plus aujourd’hui.
Par ailleurs, les habitudes et la répartition des tâches et responsabilités, ainsi que leurs délais, peuvent considérablement différer de votre pays d’origine.
La symphonie de la transaction immobilière nécessite que chacun jour sa partition au bon moment… pour éviter les « couacs » !
